Turkey CLP Regulation (SEA) Compliance

The Turkish Ministry of Environment and Urban Planning published the implementation of the Classification, Labeling, and Packaging (CLP) Regulation in the Official Gazette No. 28848 on 11 December 2013.
The regulation aligns closely with the EU CLP Regulation (EC No. 1272/2008) and aims to:
- Protect human health and the environment from potential risks posed by chemicals.
- Set administrative and technical requirements for the classification, labeling, and packaging of substances and mixtures.
Key Obligations for Manufacturers and Importers
1. Notification to Turkish C&L Inventory
- Substances placed on the market before 1 June 2015:
- Notification to the Turkish C&L Inventory was required between 1 June 2014 and 1 June 2015.
- Substances placed on the market after 1 June 2015:
- Notification must be submitted within one month of placement on the market.
2. Classification and Labeling Requirements
For Substances:
- Mandatory classification and labeling according to the new regulation started on 1 June 2015.
For Mixtures:
- Mandatory classification and labeling came into effect on 1 June 2016.
- A two-year transition period applied to products already on the market prior to this date.
3. Exporters to Turkey
A unique feature of the Turkish CLP implementation is the protection of Confidential Business Information (CBI):
- Exporters to Turkey can cover their notification requirements by appointing a Turkish Legal Representative.
- This arrangement protects business confidentiality while fulfilling the importer’s obligations under SEA.
